NYC Accident Attorney Report: Intoxicated Brooklyn Cabbie Strikes And Kills Pedestrian

A Brooklyn (NYC) cab driver was reportedly drunk when he struck and killed a pedestrian. The 36 year-old driver has been charged with DWI and Vehicular Homicide.

The victim, a 50 year-old male, was crossing W. 6th Street and Avenue O in Gravesend at approximately 6:45 pm on January 1, 2010. The driver reportedly had the green light. However, if it is proven that the driver was intoxicated at the time of the accident, he or his company could still be found civilly liable for the pedestrian's pain and suffering and wrongful death.

New City, NY Trucking Accident Leaves Three Seriously Injured

Three members of a Spring Valley, New York family were seriously injured in a trucking accident on Route 304 in New City, NY at the corner of Johnsons Lane on April 8, 2010. The trucking accident occurred at approximately 3 p.m.

Both the driver, a forty-five year-old woman and her husband were seriously injured in the crash. They were transported to Nyack Hospital where the woman was categorized as being in critical condition. The husband was in serious but stable condition. A 7-year-old girl was sitting in the back seat at the time of the crash and was less seriously injured. She was reportedly transported to Westchester Medical Center after sustaining injuries to her leg.

Taconic State Parkway Accident - New York State Trooper Injured

Recently a New York State trooper was injured in a car accident on the Taconic Parkway when his cruiser was struck by a sport-utility vehicle. The out-of-control SUV hit the cruiser, which then struck a parker flat-bed truck. The New York State trooper was sitting in his vehicle while investigating the scene of an earlier accident near the Route 100/9A exit.

The trooper was taken to Westchester Medical Center for care. He reportedly suffered "substantial" injuries. The truck driver suffered a back injury and the SUV's driver sustained minor injures.

New York Medical Malpractice Attorney Report: $5.2 Million Settlement Approved In Case Involving Death Of Mother During Childbirth

A $5.2 million settlement in a medical malpractice lawsuit involving the wrongful death of a woman during childbirth was recently approved by the New York State Supreme Court. The woman died from internal bleeding after a poorly performed Caesarean procedure.

The decedent, Diane McCable, was admitted Albany Medical Center Hospital in labor on September 3, 2007. After ten hours of labor, Dr. Cheryl Burack decided Ms. McCable needed a C-section, but passed her care off to Dr. Sean Yong-Il Lee. After performing the procedure, Dr. Lee allegedly ignored multiple calls from the attending physician saying that McCable may have severe internal bleeding. By the time Lee did get back to McCable to attempt to stop the bleeding, it was too late. In the settlement, Lee will pay $2.3 million, Burack $1.9 million and Albany Medical $1 million.

In addition to the monetary settlement, the agreement requires that Albany Medical fund a series of lectures focusing on topics related to enhancing patient safety. It also requires the hospital to buy a maternal and neonatal simulator to be used in staff training on the labor and delivery unit. Further, the settlement requires that procedures regarding the use of a machine that monitors a patient's vital signs during childbirth be changed.

Baby Seriously Injured After Being Struck By Truck In Yonkers, NY

A baby in a stroller was struck by a tractor trailer in Yonkers, NY the morning of April 3, 2010. The child reportedly suffered a fractured pelvis and leg. The baby's mother was pushing her child in a stroller when the truck, traveling north on South Broadway, hit the stroller in front of 340 S. Broadway at 10:30 a.m.

The baby, who fell out of the stroller, was taken to Jacobi Medical Center in the Bronx for treatment. The mother was not injured.

The accident remains under investigation.
